In conclusion, this paper explores the intricate dynamics of improper omission as an amplifying device within the Colombian legal context. A detailed analysis has demonstrated how improper omission allows the imputation and punishment of individuals who, without fulfilling the typical description of conduct, incur criminal liability when they abandon their role as guarantors in the absence of a nexus of avoidability. This occurs when they fail to prevent the typical results that, in the context of legal assets in their charge, (...) the perpetrator can update their conduct, but refuses to do so without sufficient justification. It is crucial to differentiate between the general clause of equivalence of improper omission and the special clause of equivalence. While the former pertains to all legal assets, the latter is limited to specific legal assets mentioned in Article 25 of the Criminal Code. This distinction is vital to guarantee coherence and proportionality in the application of criminal law, thus preventing potential arbitrariness and violations of fundamental rights while enabling effective protection of positive duties of protection of legal rights with criminal protection. In particular, the issue of extending the position of guarantor to the protection of legal interests beyond those contemplated in the first paragraph of Article 25 of the Criminal Code has been addressed. By means of practical examples and analyses of case law, it has been demonstrated how improper omission can be constituted in a variety of contexts, including situations in which typical behaviors may arise as a result of the negligence or eventual inaction of an individual, whereby the individual in question removes himself from the protection of the legal assets in his control, which he has assumed voluntarily, so that an omission is constituted without sufficient justification. In conclusion, the clarification of the concepts presented here will contribute to the ongoing academic and legal discourse on improper omission in Colombia. It will provide a comprehensive and nuanced understanding of its application and implications within the country's legal framework. Through rigorous and thoughtful analysis, we encourage continued exploration and debate on this complex issue, with the aim of enhancing and strengthening the administration of justice in Colombia. Type 2 diabetes has been considered a public health threat due to its growing prevalence, particularly in the older population. It is important to know the effects of psychosocial stress and its potential consequences for some basic cognitive processes that are important in daily life. Currently, there is very little information about how people with T2D face acute psychosocial stressors, and even less about how their response affects working memory, which is essential for their functionality and independence. Our aim was (...) to characterize the response to an acute laboratory psychosocial stressor and its effects on WM in older people with T2D. Fifty participants with T2D from 52 to 77 years old were randomly assigned to a stress or control condition. Mood and physiological responses to tasks were measured. In addition, participants completed a WM test before and after the stress or control task. Our results showed that the TSST elicited higher negative affect and greater C and sAA responses than the control task. No significant differences in WM were observed depending on the exposure to stress or the control task. Finally, participants who showed higher C and sAA responses to the stressor had lower WM performance. Our results indicate that medically treated older adults with T2D show clear, typical mood and physiological responses to an acute psychosocial stressor. Finally, the lack of acute psychosocial stress effects on WM suggests that it could be related to aging and not to this disease, at least when T2D is adequately treated. (shrink)

Within the results, 56.5 % of respondents understood the concept of LTE, and 90 % applied it actively. The objective of this work is to establish a relationship between the cutting time in rocks, determining a speed and the point load strength index test, Is, to characterize the rock in terms of resistance and avoid sending samples to laboratories. As a first stage, on andesite samples, 5 x 5 x 10 cm test tubes were made. After the elaboration they were subjected to cutting, using an electric floor cutter and the time was evaluated. This cut was made in (...) a transversal way and two parts were obtained, one of them with dimensions 5 x 5 x 5 cm, approximately. In a third stage, the point load strength test was carried out in a press built for this purpose. Finally, the cutting speeds were correlated with the point load test values and only when rock samples do not pigeonhole on the proposed relationship, send them to the laboratory. This paper offers some insights and clarifications of the paramount role that Mexico has had in the forging of first-order cybernetics. Our account starts with Arturo Rosenblueth as a key intellectual figure in the foundation and formation of the field. After revisiting a historical context of people and places, we proceed to a cultural and media archeological investigation that helps us obtain new insights into the ongoing effort to intertwine the complex intellectual networks across different countries in Latin America, North (...) America, and Europe. We then present cases and first-hand interviews to discuss the legacy of cybernetics in Mexico around institutions where Rosenblueth was affiliated, mainly the Institute of Cardiology and, later on, the CINVESTAV at the Instituto Politécnico Nacional. We claim that subjective affinities are as important as common scientific goals to establish and keep connections alive, necessary to the development of a research field. As the active compound in spicy peppers, capsaicin represents a local component to the definition of cybernetics. Ultimately, the paper aims to contribute to the research on the importance of cybernetics in Latin America. (shrink)

The Quantified argument calculus (Quarc) has received a lot of attention recently as an interesting system of quantified logic which eschews the use of variables and unrestricted quantification, but nonetheless achieves results similar to the Predicate calculus (PC) by employing quantifiers applied directly to predicates instead. Despite this noted similarity, the issue of the relationship between Quarc and PC has so far not been definitively resolved. We address this question in the present paper, and then expand upon that result. Utilizing (...) recent developments in structural proof theory, we develop a G3-style sequent calculus for Quarc and briefly demonstrate its structural properties. We put these properties to use immediately to construct direct proofs of the meta-theoretical properties of the system. We then incorporate an abstract (and, as we shall see, logical) predicate into the system in a way that preserves all the structural properties. This allows us to identify a system of Quarc which is deductively equivalent to PC, and also yields a constructive method of demonstrating the Craig interpolation theorem (which speaks in favor of the aforementioned predicate being logical). We further generalize this extension to develop a bivalent system of Quarc with defining clauses that still maintains all the desirable properties of a good proof system. (shrink)

The current work represents a piece of research on the family firm of the semasiological, interpretive or culture creation type. In it we carry out a comparative analysis of the organizational culture of this type of firm along with firms not considered to be family firms, using as theoretical framework generally accepted theories in business administration, such as the systems, neoinstitutional, transformational leadership, and social identity theories. Our findings confirm the existence of certain elements of culture, especially values and allow (...) us to propose a value-based model to help family firms to survive through different family generations. Background: Microbiome biomarker discovery for patient diagnosis, prognosis, and risk evaluation is attracting broad interest. Selected groups of microbial features provide signatures that characterize host disease states such as cancer or cardio-metabolic diseases. Yet, the current predictive models stemming from machine learning still behave as black boxes and seldom generalize well. Their interpretation is challenging for physicians and biologists, which makes them difficult to trust and use routinely in the physician-patient decision-making process. Novel methods that provide interpretability and biological insight (...) are needed. Here, we introduce "predomics", an original machine learning approach inspired by microbial ecosystem interactions that is tailored for metagenomics data. It discovers accurate predictive signatures and provides unprecedented interpretability. The decision provided by the predictive model is based on a simple, yet powerful score computed by adding, subtracting, or dividing cumulative abundance of microbiome measurements. -/- Results: Tested on >100 datasets, we demonstrate that predomics models are simple and highly interpretable. Even with such simplicity, they are at least as accurate as state-of-the-art methods. The family of best models, discovered during the learning process, offers the ability to distil biological information and to decipher the predictability signatures of the studied condition. In a proof-of-concept experiment, we successfully predicted body corpulence and metabolic improvement after bariatric surgery using pre-surgery microbiome data. -/- Conclusions: Predomics is a new algorithm that helps in providing reliable and trustworthy diagnostic decisions in the microbiome field. Predomics is in accord with societal and legal requirements that plead for an explainable artificial intelligence approach in the medical field. (shrink)

This note is a generalization and improved interpretation of the main result of Karni and Schmeidler. A decision-maker is supposed to possess a preference relation on acts and another preference relation on state-prize lotteries, both of which are assumed to satisfy the von Neumann–Morgenstern axioms. In addition, the two preference relations restricted to a state of nature are assumed to agree. We show that these axioms are necessary and sufficient for the existence of subjective expected utility over acts with state-dependent (...) utility functions and a subjective probability measure. This subjective probability measure is unique when conditioned on the set of states of nature in which not all the prizes are equally desirable. (shrink)

The normalization in the path integral approach to quantum field theory, in contrast with statistical field theory, can contain physical information. The main claim of this paper is that the inner product on the space of field configurations, one of the fundamental pieces of data required to be added to quantize a classical field theory, determines the normalization of the path integral. In fact, dimensional analysis shows that the introduction of this structure necessarily introduces a scale that is left unfixed (...) by the classical theory. We study the dependence of the theory on this scale. This allows us to explore mechanisms that can be used to fix the normalization based on cutting and gluing different integrals. “Self-normalizing” path integrals, those independent of the scale, play an important role in this process. Furthermore, we show that the scale dependence encodes other important physical data: we use it to give a conceptually clear derivation of the chiral anomaly. Several explicit examples, including the scalar and compact bosons in different geometries, supplement our discussion. (shrink)

Should Lesbian and women's events have policies banning sadomasochists or sadomasochistic acts? This question is being heatedly debated in the Lesbian community. In this paper, I examine the moral and political problems with sadomasochism from a Lesbian-feminist perspective, concluding that sadomasochism is antifeminist and antiliberatory for many reasons. Then, given this conclusion, I explore how events such as women's music festivals should determine their policies about sadomasochism.

Si bien en la filosofía de las ciencias ya se han explorado algunos ejemplos provenientes de la bioquímica como casos de estudio, la filosofía de la bioquímica es una subdisciplina naciente. En este artículo estudiaremos dos problemas filosóficos de relevancia contemporánea en esta ciencia. Por un lado, examinaremos las bases epistemológicas del problema del plegamiento de proteínas. En particular lo relacionado con la predicción de la estructura tridimensional de las proteínas a partir de su secuencia, asunto que ha dado mucho (...) que hablar debido a los nuevos avances utilizando deep learning. Por otro lado, exploraremos el problema in-vitro/in-vivo y, más generalmente, el problema de la extrapolación en las ciencias biológicas. Finalmente, a partir de las consecuencias de ambos temas consideraremos algunas reflexiones filosóficas generales acerca del reduccionismo, el pluralismo y el lugar de la bioquímica en las ciencias biológicas. This article investigates the proof theory of the Quantified Argument Calculus as developed and systematically studied by Hanoch Ben-Yami [3, 4]. Ben-Yami makes use of natural deduction, we, however, have chosen a sequent calculus presentation, which allows for the proofs of a multitude of significant meta-theoretic results with minor modifications to the Gentzen’s original framework, i.e., LK. As will be made clear in course of the article LK-Quarc will enjoy cut elimination and its corollaries.

Fazer a genealogia do poder nunca foi o propósito claro de Foucault. No entanto, a questão do poder foi tema recorrente em suas investigações a ponto de estudiosos do trabalho do filósofo sugerirem uma divisão e organização de seu trabalho a partir de três eixos teóricos. Dentro dessa perspectiva, a analítica do poder marcaria a trajetória filosófica de Foucault na década de 1970. De fato, até 1994, ano de publicação do conjunto de textos, entrevistas e conferências de Foucault no Dits (...) et écrits, a questão da analítica do poder era majoritariamente conhecida a partir de livros como Surveiller et punir e Histoire de la sexualité I: la volonté de savoir. Com o início da publicação dos cursos no Collège de France a partir de 1997 as interpretações a respeito da analítica do poder sofrem um alargamento. Mas é somente em 2015 que a totalidade dos cursos de Foucault no Collège de France foram publicados, abrindo um importante caminho para a investigação a respeito das primeiras reflexões a respeito do poder. No presente artigo procuramos mostrar como os primeiros passos da analítica do poder de Michel Foucault se dá a partir de um contexto gauchiste ainda configurado em termos de dinástica do saber. Nesse sentido, procuramos mostrar como o período da dinástica corresponde a um esboço teórico, tentativas primeiras de conceituação do poder, marcadamente desenvolvido em contraposição com o marxismo. Essa contraposição se dá sobretudo na recusa tanto do esquema marxista de infra-superestrutura, quanto do modelo contratualista de sociedade estatal. (shrink)

This article proposes a study on love as an ambivalent experience that incorporates, along with the pleasant, essentially pain, and whose experience requires preparation and self-knowledge. To do this, I have taken as a starting point fragment 130 of sappho and the Platonic notion of soul of Phaedrus, to culminating in a reconsideration of pain as a necessary experience that allows the understanding of what sappho’s calls “bittersweet” love. Free logics is a family of first-order logics which came about as a result of examining the existence assumptions of classical logic. What those assumptions are varies, but the central ones are that the domain of interpretation is not empty, every name denotes exactly one object in the domain and the quantifiers have existential import. Free logics usually reject the claim that names need to denote in, and of the systems considered in this paper, the positive free logic concedes that (...) some atomic formulas containing non-denoting names are true, while negative free logic rejects even the latter claim. Inclusive logics, which reject, are likewise considered. These logics have complex and varied axiomatizations and semantics, and the goal of this paper is to present an orderly examination of the various systems and their mutual relations. This is done by first offering a formalization, using sequent calculi which possess all the desired structural properties of a good proof system, including admissibility of contraction and cut, while streamlining free logics in a way no other approach has. We then present a simple and unified system of abstract semantics, which allows for a straightforward demonstration of the meta-theoretical properties, and offers insights into the relationship between different logics. The final part of this paper is dedicated to extending the system with modalities by using a labeled sequent calculus, and here we are again able to map out the different approaches and their mutual relations using the same framework. Over the last decade, our appreciation of the importance of the nucleolus for cellular function has progressed from the ordinary to the extraordinary. We no longer think of the nucleolus as simply the site of ribosome production, or a dynamic subnuclear body noted by pathologists for its changes in size and shape with malignancy. Instead, the nucleolus has emerged as a key controller of many cellular processes that are fundamental to normal cell homeostasis and the target for dysregulation in many (...) human diseases; in some cases, independent of its functions in ribosome biogenesis. These extra‐nucleolar or new functions, which we term “non‐canonical” to distinguish them from the more traditional role of the nucleolus in ribosome synthesis, are the focus of this review. In particular, we explore how these non‐canonical functions may provide novel insights into human disease and in some cases new targets for therapeutic development. (shrink)

While concern about public irrationality and antiscientific movements is not new, the increasing power of right-wing populist movements that promote distrust of expertise and of scientific institutions gives such concerns a new context. Experience with classic pseudosciences such as creationism, and the long-running efforts by defenders of science to oppose such pseudosciences, may also help us understand today’s post-truth populism. The politics of creationism and science education in the United States and in Turkey does not, however, suggest easy answers. Moreover, (...) there are important features of politics in liberal democracies that drive a populist backlash, which makes it counterproductive for defenders of science to call for deference to all forms of expertise claimed by professionals. There is a danger that the rhetoric of reason that is used to defend science will become part of a more general apologetics for an unsustainable status quo. (shrink)
